Acceptance of Terms
Welcome to Postbox Games. The PostboxGames.com Web site and the Postbox Games service are owned and operated
by Postbox Games, Ltd. (hereinafter referred to as "Postbox Games","we" or "us").
Postbox Games provides its services to you subject to the following Terms of Use, which may be updated
occasionally, at our sole discretion, with or without notice to you. The most current version of these Terms
of Use will always be on this page and will supersede all previous versions. There will always be a link to
the most current Terms of Use on the www.postboxgames.com home page. By using, visiting,
or browsing the PostboxGames.com Web site, you accept and agree to be bound by these terms.
These Terms of Use set forth the entire agreement regarding all the subjects we discuss herein. If any provision
of this agreement is found to be unlawful, void, or unenforceable, it will not affect the validity and
enforceability of any other provision.
Joining Postbox Games
You must be 18 years of age or older and reside in the United Kingdom to use the Postbox Games service.
The games we distribute and the content on the PostboxGames.com web site are strictly for personal and
non-commercial use. We agree to deliver games to our members and grant you a license to access the
PostboxGames.com site for that limited purpose only. Any unauthorized use of any game, the PostboxGames.com
web site or their contents will terminate your membership and the limited license to access our web site
granted by us.
Privacy
Any information you submit to us, or any information we collect, is subject to the Postbox Games
Privacy Policy.
Your Account
If you use the PostboxGames.com site or the Postbox Games service, you represent and warrant that
all information you supply to Postbox Games is complete and accurate. You are solely responsible for
maintaining the confidentiality of your account information, including your password, and for restricting
access to your computer. By using the PostboxGames.com Web site, you agree to accept responsibility for all
activities that occur under your account or password. It is also your responsibility to provide and maintain
an accurate and working e-mail address, delivery address, current credit card/debit card and billing
information, at all times.
Delivery and Return of Games
Rental requests are fulfilled Monday to Friday. We will send you a confirmation e-mail when you return a game
and when we send you another game. You can view your currently playing games by accessing your Game Park.
Postbox Games uses Royal Mail 1st class prepaid envelopes to have games delivered to you and returned to us.
Please allow for Royal Mail delivery times. Postbox Games is not responsible for delayed or misdirected mail.
Return postage of rented games is paid by Postbox Games. We advise obtaining a 'proof of postage' receipt
from the Royal Mail when returning your games to confirm they have been accepted into the postal system to be
returned to Postbox Games. These can be obtained free of charge from any Post Office at the time of posting.
We will do our best to get the games you have requested to you as quickly as possible. However, we do operate
a fair use policy that aims to ensure a balanced experience for all our members. This means that we give
priority to members who don't rent high numbers of games from us. Therefore, members who rent the most games
from us might experience lower posting priority. By allocating games in this way we ensure a fair system
for all Postbox Games members.
Although we allow you to prioritise the order in which we send you games, we cannot guarantee that you will
always receive the game in the order shown in your Game Park. You will not hold us responsible for any delays,
outside our control, which relate to the posting or delivery of games.
We provide you with one addressed, prepaid first class peel and seal reply envelope per game sent to you
to allow you to return the game. If you lose the envelope for a game we can send a replacement to you.
You may also return any game to us by placing the game in its jewel case, putting the case into a padded
envelope, and posting the envelope to:

If you lose the jewel game case, you agree to ensure the game does not get damaged when it is returned to us.
You agree that Postbox Games may charge you £25 per game for damage caused to games returned without adequate
protective packaging. Place the game into a padded envelope, preferably with some thick cardboard to prevent
it bending, and post it to the address above. Please include a note with your name and the email address used
for your Postbox Games account so that we can promptly match the returned game to your account.
Any games which are reported as missing on your account will require an investigation with the Royal Mail
to verify their loss. Games reported as missing on your account will require you to provide a 'proof of postage'
receipt to validate your claim. Postbox Games reserves the right to debit your credit/debit card with the
recommended retail price for any missing games that are not accompanied with a valid 'proof of postage' receipt.
Any games reported by you as not being received will require you to complete a Royal Mail claim form for the
missing games. Failure to sign and return the claim form to Postbox Games is deemed that you do not support
the claim and Postbox Games reserve the right to debit your account with the recommended retail price for the
missing item(s). Claim forms must be returned to Postbox Games via recorded delivery within 7 working days of
receipt to avoid the charge being applied to your account.
Membership and Billing
Free Trials
We offer free trials of the Postbox Games service to allow members to become familiar with the many benefits
of the membership plans we offer. The free trial may not be made available from time to time. Postbox Games may
change the duration of the free trial period at its sole discretion. These trials are available to new
(first-time) members only, limit one per household, and cannot be combined with any other offer. This
limited introductory free trial offer is only valid in the United Kingdom. Subsequent free trials at the same
address will be permitted only at the discretion of Postbox Games. A valid credit card/debit card is required.
We will authorise the card in the amount of the membership level you choose in order to verify the account,
but we receive no money from this transaction, even if your bank or credit card company temporarily holds the
funds from your account.
At the end of your free trial, you will automatically become a paying member unless you cancel your
membership and return any of our games in your possession to us within seven days of your notice to cancel.
Postbox Games will begin billing your credit card/debit card for the monthly membership fee on the first day
following the end of your free trial period. YOU MUST CANCEL YOUR MEMBERSHIP PRIOR TO THE END OF YOUR FREE
TRIAL PERIOD TO AVOID HAVING YOUR CREDIT CARD/DEBIT CARD CHARGED.
Membership Fees
As a Postbox Games member, you agree that we are permitted to charge your credit card/debit card on a monthly
basis for your membership fee, and any other charges you may incur in connection with your use of
PostboxGames.com. The membership fee will be billed in full on the first day of your paid membership and on
each monthly anniversary thereafter, unless and until you cancel your membership. If your billing date lands
on a day not contained in a given month, you will be billed on the last day of that month. For example, if your
paid membership began on August 31st, your next billing date would be September 30th.
Postbox Games reserve the right to charge you a late fee of £15 for any refused monthly payments to your
account as a result of your credit/debit card being continually declined by your bank or credit card company.
Postbox Games is not responsible for any additional bank fees, interest charges, finance charges, over draft
charges, or other fees resulting from charges billed by Postbox Games. In addition, we do not give pro-rated
refunds for unused time if cancellation is initiated during the middle of a billing cycle. We also reserve
the right to change our fees, but we will notify you in advance if we do so.
Lost/Unreturned/Damaged Games
You agree to allow us to charge your credit card/debit card for the recommended retail price of a game
in the following situations:- If you have not returned a game to us within 7 days of cancelling your
free trial or paid membership;
- If you have lost a game and reported it to us as lost; or
- If
you have damaged a game whether or not you reported it to us as damaged.
Returning Games for Account Cancellation
When returning games prior to cancelling your account, we require you to obtain a 'Proof of Postage' receipt
from the Royal Mail to confirm the games have been returned safely and before your next billing date.
A 'Proof of Postage' receipt can be obtained at any Post Office and is free of charge. This will prevent
any further charges being made to your account for non returned games. Any games lost in transit prior to or
after cancellation without a 'Proof of Postage' receipt will be deemed as lost by the member. Postbox Games
reserves the right to debit the subscribers' credit/debit card the current recommended retail price of any lost
game.
Games Remain Postbox Games Property
All games remain the property of Postbox Games at all times. You agree not to resell any games supplied by us
to you, make them available to hire, copy or alter any rented game in any way or allow any such unauthorised or
illegal use to occur.
Use and Care for Games
Please handle the games with care so as not to damage them. The subscriber undertakes to treat the games and
their associated packaging with the utmost care at all times. Postbox Games reserves the right to debit the
subscribers' credit/debit card the current recommended retail price of any game which is returned in a non
re-usable condition (reasonable wear and tear excepted). The recommended retail price constitutes the most
competitive retail price available to Postbox Games. Postbox Games will contact the member to discuss this before
debiting the subscribers' credit/debit card.
Limitations on Liability
The contents of the PostboxGames.com site, and the games we deliver are provided "as is."
We make no representations or warranties, whether express or implied, of any kind about their accuracy
or functionality. We assume no liability or responsibility for any errors or omissions in the content of
the PostboxGames.com site, for any failures, delays, or interruptions in the delivery of any content contained
on the PostboxGames.com site, for any losses or damages arising from the use of the content provided on the
PostboxGames.com site, or for any conduct by users of the PostboxGames.com site. To the full extent permissible
by law, Postbox Games disclaims all representations and warranties about the games we deliver, including, for
example, warranties of merchantability, fitness for a particular purpose, and non-infringement. In addition,
we do not represent or warrant that the information accessible via our site is accurate, complete, or current.
In no event shall PostboxGames.com, its shareholders, directors, officers, or employees be liable
(jointly or severally) to you for any special, incidental, indirect, or consequential damages of any kind,
or any damages whatsoever resulting from loss of use, data, or profits, whether or not advised of the
possibility of damage, and on any theory of liability, arising out of or in connection with the use or
performance of any games or the information on our website. If any applicable authority holds any portion
of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted
by applicable law.
Intellectual Property
All content and data included on the PostboxGames.com site, or in games provided to you, including but
not limited to graphics, text, logos, button icons, and software, is the property of Postbox Games, or its
suppliers and is protected by United Kingdom and international copyright laws. No content may be reproduced
or used without express written permission from Postbox Games, Ltd. and any other copyright holder.
Postbox Games is a registered trademark of Postbox Games, Ltd. Postbox Games trademarks may not be used in connection with any product or service that is not Postbox Games, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Postbox Games. All other trademarks not owned by Postbox Games that appear on the PostboxGames.com site or on games are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Postbox Games. Any images of persons or personalities contained on the PostboxGames.com site or in games shall not be an indication of endorsement of any particular product or our service unless otherwise specifically indicated.
Web Site Content
Under no circumstances shall Postbox Games, Ltd. or its shareholders, officers, directors, or employees be held liable for any loss or damage caused by your reliance on information obtained through the PostboxGames.com site. It is your responsibility to evaluate the information, opinion, advice, or other content available through the PostboxGames.com site.
Some hyperlinks on PostboxGames.com may lead to other Web sites that are not owned or controlled by Postbox Games, Ltd. Postbox Games has not reviewed these sites and has no control over the content of such sites. Connecting to linked sites and/or downloading any information from linked sites is done entirely at your own risk. Submitted Reviews
By posting a review on the PostboxGames.com web site, you grant Postbox Games a royality-free, perpetual, non-exclusive, irrevocable, and fully sub licensable right to use, modify, distribute, publish, reproduce, adapt and display such content.
Right to Terminate
We reserve the right to terminate or restrict your membership, or the use of our service, without notice, for any reason whatsoever, or for no reason.
Governing Law and Jurisdiction
These terms of use are governed by English law and subject to exclusive jurisdiction of the English courts.
